AGREEMENT FOR FULL LEGAL SERVICES

This Agreement for Full Legal Services (“Agreement”) is made between You, and MyImmigration, LLC (“MyImmigration”). This Agreement governs the scope and duration of MyImmigration’s agreement to provide You the Legal Services defined below. This agreement covers matters relating to the appropriate immigration form(s) to be filed with U.S. Citizenship and Immigration Services (USCIS). The immigration attorney assigned to your case is actively licensed in the state of Utah and is authorized by federal law to practice immigration law in all 50 states including representing you before United States Citizenship and Immigration Services. 

1. Legal Services to be Provided

To assist you obtain immigration benefit(s) for which you may be eligible, MyImmigration will provide the following services: 

 

  • Up to 90 minutes of telephone/video consultation(s) with a MyImmigration attorney as needed for the purpose of filing the appropriate immigration form(s), 
  • Access to and use of MyImmigration’s attorney certified virtual interview form preparer to assist you complete USCIS immigration form(s) or other form preparer software, if needed,
  • If virtual interview form preparer is not available, a MyImmigration paralegal/attorney will assist you in filling out the appropriate immigration form(s), 
  • MyImmigration attorney review of Your completed forms and uploaded documents to include the following: 
    1. Review for overall eligibility. 
    2. Review for omissions of key information or documents.
    3. Examine for typographical errors that might delay processing.
    4. Confirm consistent spellings of names and places throughout the application.
    5. Check for inconsistent, illogical or conflicting dates.
    6. Review for obviously illogical entries.
    7. Search for entries that conflict with each other.
    8. Analyze application to confirm eligibility to file for the immigration benefit sought, based on the answers, information and documents You provided.
    9. Verify that the supporting documents you have provided confirm the information supplied by You. 
  • Compiling, organizing, and uploading evidence in support of Your application,
  • Filing your form(s) with USCIS on your behalf via ELIS or mail, or mailing you the completed forms with supporting evidence with a pre-paid envelope for you to mail to USCIS, and
  • Provide USCIS with a G-28, Notice of Notice of Entry of Appearance as Attorney or Accredited Representative to handle correspondence.

2. Other Services Included if Needed for No Additional Legal Fee

  • Up to an additional 30 minutes of telephone/video consultations  with a MyImmigration attorney after Your forms are filed with USCIS, if needed,
  • Assistance with responding to a request for evidence from USCIS, if any, and
  • Handling additional correspondence from USCIS, if any. 

3. Legal Fee

The fee is a flat fee based on the immigration form(s) You are filing with USCIS. Such a fee will either be posted on a website or agreed to in writing. The fee will initially be placed in a client trust account until the fee is earned or expenses incurred. The legal fee is earned either when MyImmigration files your form(s) with USCIS or when MyImmigration mails the form(s) to you to be mailed to USCIS. If it is determined the form(s) is inappropriate to file with USCIS, the fee is earned upon the conclusion of the final consultation with MyImmigration. MyImmigration’s representation of You will continue until the conditions described in Clause 9 of the Agreement are fulfilled. For this Agreement, the legal fee is as indicated on MyImmigration’s website for each form being filed with USCIS. 

 

According to the Terms of Use agreement on MyImmigration’s website, a full refund will be issued if you make the refund request before legal fees are earned. See the Terms of Use agreement for additional details about the refund policy. 

 

We want you to be 100% satisfied with our Services.  If you are less than satisfied or believe there has been an error in billing, please contact our Customer Service Department at (385) 955-4711 or click here to request a refund.

4. Government Costs and Expenses

USCIS charges fees for each form filed with them. Their fee schedule is posted at USCIS.gov. MyImmigration’s website may, for your convenience, list the USCIS fees for each form you selected including any biometric fees. As part of this Agreement, if MyImmigration is filing your form with USCIS for You, Your total payment may also include the USCIS filing fee(s) and such payment will also be placed in a client trust account. MyImmigration may collect the government filing fees upfront with the legal fee or may collect the filing fee from you at a later point during the representation of you. Upon filing the form, MyImmigration will withdraw the funds reserved for paying the USCIS fee(s) from the client trust account and pay USCIS your filing fee for You. In the event Your forms don’t get filed, MyImmigration will return the USCIS fees to you. 

5. Legal Services Not Included in this Agreement

Attorney presence at USCIS interviews. If USCIS requires You to be present at their office for an interview or any other reason, this Agreement does not cover MyImmigration attorneys to be present with you. However, you may request this legal service and it may be available to you in accordance with clause 6 below. 

 

Response to USCIS notices of intent to deny. This agreement does not cover responses to notices of intent to deny; however, you may request this legal service and it may be made available to you in accordance with clause 6 below. 


Appeals, Motions, and Other Post-Decision Communications. If USCIS denies your case(s) and you would like to make a motion to reopen or reconsider Your case or appeal the case, this Agreement does not cover these types of services. Nor does the agreement cover any type of communication to USCIS after the decision has been made on Your case.

6. Additional Legal Services at Your Request Available at Additional Cost

If, during the course of representation, You would like additional legal services not covered under this agreement, You may request the following additional services for an additional legal fee.

 

  • Additional consultation. You may request additional consultation time with a MyImmigration attorney beyond what this Agreement allots. Any additional consultation you would like is available in 15 minute increments at a rate of $200 per hour. 
  • Assistance with responding to a notice of intent to deny. My Immigration strives to ensure that all necessary documents and information are provided to USCIS. In the rare event that USCIS issues a notice of intent to deny, you  may request MyImmigration to assist you respond to USCIS and MyImmigration may require an additional legal fee. Additional legal fees will be agreed upon in writing and will be based on the complexity and anticipated time needed to complete the response to USCIS.  
  • Attorney presence at a USCIS office. At your request, MyImmigration will attempt to find an independent attorney to be present with you at a USCIS office. MyImmigration will not charge you for this, but may collect a referral fee from the independent attorney. The Independent attorney will charge you legal fees for their time spent with you. 

7. Non-lawyer Ownership of MyImmigration

This law firm is owned by one or more non-lawyers. One or more people who own this company are not lawyers. This means that some services/protections, like the attorney-client privilege, may be different from those you can get at another law firm. 8. Your Obligations

You retain control over all aspects of Your immigration matter and You remain responsible for all decisions made in the course of Your immigration matter. You agree to (a) provide truthful and complete information when completing your application using the MyImmigration website; (b) provide truthful and complete information in any communications between You and MyImmigration; (c) carefully consider MyImmigration’s advice before making any major decisions in Your immigration matter; and (d) advise MyImmigration of any new developments or new or changed information related to Your application or immigration matter of which You learn during the course of this Agreement and prior to the Termination of Legal Services, as defined below.

9. Termination of Legal Services

Unless You and MyImmigration otherwise agree in writing, this Agreement, and MyImmigration’s representation of You, shall automatically be fulfilled and completed when USCIS makes a final decision on Your case. You may terminate this Agreement for any or no reason at any time, although You will remain legally obligated to pay MyImmigration any fee it has already earned. In such a case, MyImmigration will refund all unearned legal fees with a list of services provided and corresponding fees. 

 

MyImmigration may terminate this Agreement if, in MyImmigration’s sole judgment, You have failed to fulfill one or more of Your material obligations under this Agreement, for other good cause, or any reason authorized or required by law, rule or regulation, including professional rules that govern the conduct of MyImmigrations. In such a case, MyImmigration will refund all unearned legal fees with a list of services provided and corresponding fees.

10. Confidentiality of Information

The information you provide to MyImmigration will be held confidential in accordance with the attorney-client privilege as outlined in section 1.6 of the Utah Rules of Professional Responsibility. In addition to MyImmigration attorneys, Your information may also be accessed by MyImmmigration owners and authorized professional information technology professionals to continually improve MyImmigration’s client interface software and case management software. MyImmigration owners may also have access to your contact information for marketing purposes in accordance to MyImmigration’s Privacy Policy. Also, authorized client relations specialists affiliated with MyImmigration may have access to your information to prepare your application(s) and supporting documents for filing with USCIS and further assist You with any questions or concerns. 

11. Third Parties

MyImmigration is a law office that is an independent entity operating as a limited liability company under the laws of the state of Utah. Upon your consent a third party form preparation company, that may or may not be affiliated with MyImmigration, will transfer your information it gathered to MyImmigration to provide legal services as defined in this agreement. This limited scope agreement only covers the legal services as defined and does not extend to the initial preparation of your application or petition and the form preparation fees. You agree MyImmigration is not responsible for or liable for any errors, negligence, or injury that may be caused by the third party form preparation company.  If you have questions about form preparation services or form preparation fees, you should contact the third party form preparation company that provided you that service.

12. Your Informed Consent

By entering into this Agreement, You confirm that You have read this entire Legal Services Agreement and understand all of its terms, and that You understand and accept the limitations on the scope of MyImmigration’s Legal Services provided herein, and Your obligations identified above.
