Intercontinental relationships are becoming more and more common in today’s world. However, if you’re a United States citizen and a Houston resident and your star-crossed lover lives in their home country, planning your lives together can seem like an impossible task. U.S. immigration laws are strict, and if your partner enters the country on the wrong visa to get married, it could cause problems. Fortunately, this is where the K-1 Fiancé(e) visa comes to the rescue.
Let MyImmigration close the gap between you and your soulmate.
The process of bringing your romantic partner into the country so that you can become married partners should not be taken lightly. Any errors or omissions on the required forms can delay the process and result in lost processing fees. To ensure that you follow everything to the letter of the law, it’s crucial that you work with a Houston K-1 Fiancé(e) attorney.
Let us help you navigate the K-1 visa requirements today.
Once you’ve found your soulmate, you’ll want to marry and spend your lives together. If they live in another country, this adds another layer of complexity to your relationship. The K-1 visa is designed to bring them legally into the United States for the sole purpose of marriage.
Don’t take this important step without expert guidance. A Houston K-1 Fiancé(e) can help guide you through the process easily and confidently, allowing you to focus on wedding plans and your future together as a married couple instead of worrying about filing out forms and supplying supplemental documents.
Living in Houston while your soulmate is on the other side of the world can be heartbreaking. Unfortunately, they can’t enter the country with a tourist visa or any other type of visa for the purpose of marriage. While this may seem unfair, USCIS would see this as fraudulent activity. The answer is to file for a K-1 visa, but without the expert guidance of an immigration lawyer, the process can be wrought with obstacles and hurdles to cross.
Here’s a look at the K-1 visa process:
The partner in the United States will first need to file Form I-129F (Petition for Alien Fiancé(e)). This will initiate the process of bringing your foreign-born partner into the country on a K-1 visa. You’ll need to provide proof of a romantic relationship, which is usually achieved with photos, travel records, emails, and texts. Processing times can vary, but expect this part of the process to take at least a few months.
USCIS (U.S. Citizenship and Immigration Services) will review the petitioner’s information. It’s not uncommon for them to send a Request for Evidence (RFE). It could include a request for further evidence of a romantic relationship or proof that the petitioner can financially provide for their partner. Once approved, you’ll receive a Notice of Action (Form I-797), and your case will be forwarded to the National Visa Center.
The petition will be forwarded to the U.S. embassy or consulate in the fiancé’s nation once the NVC assigns a case number.
Once approved, the foreign fiancé(e)’s passport will have the K-1 visa attached. They must enter the United States within six months and have a 90-day window to marry.
After the marriage takes place, the foreign spouse can file Form I-485 (Application to Register Permanent Residence or Adjust Status). This process will begin the clock for their two-year conditional residency. Ninety days before this two-year ends, file Form I-751 (Petition to Remove Conditions on Residence) to convert the two-year conditional green card to a permanent one.
