Navigating the Los Angeles K-1 Fiancé(e) Visa Process

Intercontinental love can be an expensive and frustrating experience. Once you’ve found your soulmate, you want to begin your life with them as soon as possible. Unfortunately, immigration regulations can make this incredibly difficult. So how do you get your partner legally into the United States?

The first step to making your marriage happen is to apply for a K-1 fiancé(e) visa. You’ll want to take this first step seriously to ensure them safe passage into Los Angeles and the rest of the country. Take control of your life by working with the MyImmigration team and let them expertly guide you through the fiancé(e) visa process.

The Fiance Visa Process Can Be Challenging

When exchanging vows with the person you want to spend the rest of your life with is your goal, you want it to be a beautiful experience. Sharing your lives together in Los Angeles can quickly consume your thoughts. But what if your soulmate isn’t a U.S. citizen and they’re thousands of miles away living in their home country? How do they come to the States legally so that you can become legally wedded partners?

The missing piece to this puzzle is to file for a  K-1 fiancé(e) visa. Our experienced Lost Angeles fiancé(e) visa lawyers have helped countless couples tie the knot. Here’s how the process works:

Petition for Alien Fiancé(e)

The first step to bringing your partner legally into the country is to file Form I-129F (Petition for Alien Fiancé(e)). This form will ask you to prove your romantic relationship. This is generally accomplished by providing copies of photos of you two together, travel records to visit each other, and copies of emails and text messages that state your mutual intention of getting married. While this may seem invasive, a romantic relationship must be proven to be accepted.

USCIS Review

USCIS (U.S. Citizenship and Immigration Services) will review Form I-129F. Be aware that it’s not uncommon for them to send you a Request for Evidence (RFE). It could be to further prove your romantic relationship or to prove that you can financially support your partner. If approved, you’ll receive a Notice of Action (Form I-797), and your case will be forwarded to the National Visa Center.

National Visa Center (NVC) Processing

The NVC will assign your petition a case number and send it to the U.S. embassy or consulate closest to where your partner lives.

Further Processing

Once you’ve received a case number, your foreign-born partner must complete Form DS-160 (Online Nonimmigrant Visa Application) and request an interview at their local embassy or consulate. For the interview, the following is required:

  • Passport
  • Proof of a medical examination
  • Proof of the relationship
  • Proof of shared financial responsibilities or proof that their U.S. partner can support them

Visa Approval

If approved, the foreign-born partner will have a K-1 visa attached to their passport. This visa will allow them to legally enter the United States, entering the country within 6 months of the visa being issued. Once in the country, the couple must marry within 90 days.

Adjustment of Status

After the marriage takes place, the foreign spouse can file Form I-485 (Application to Register Permanent Residence or Adjust Status), which allows them to remain in the United States as a part of their two-year conditional residency. Ninety days before this two-year period ends, file Form I-751 (Petition to Remove Conditions on Residence) to convert the two-year green card to a permanent one.
