To legally reside and obtain employment in the United States, immigrants must have a green card. This document allows them to maintain permanent residency in the country. If a member of your family has U.S. residency (green card holder), they have the opportunity to sponsor you to join them in the United States. Your immediate family members, who are legally in the country, can petition for you to receive a green card. They’ll first have to file Form I-130 (Petition for Alien Relative) and, once approved, Form DS-260 (Immigrant Visa Application).
Employment-based immigration is another route to getting a green card. However, this is generally achieved when you’ve already been offered a job by a U.S. company. The employer can petition the USCIS by first filing out Form I-140 (Immigrant Petition for Alien Worker). Depending on your current immigration status, they may require Form I-485 (Application to Register Permanent Residence or Adjust Status).
Although not a standard route to residency, individuals from certain countries with a low rate of immigration to the United States are eligible to enroll in the Diversity Immigrant Visa Program, commonly called the Green Card Lottery. Applicants must hold a high school diploma or regional equivalent and have a history of employment.
Those with a romantic partner who is a citizen of the United States can apply for a K-1 visa, sometimes known as a fiancé(e) visa or sweetheart visa. While this isn’t a direct path to getting a green card, it does allow the partner to legally enter the country with the intention of being married within 90 days of entry. Once legally married, the non-U.S. spouse will then need to file for residency.
