Beginning a new life in New York City with your partner who lives abroad should be done legally and without cutting any corners. Unfortunately, many star-crossed lovers have found the hard way that if not done properly, their dreams of being husband and wife can quickly come to an end. You’ll need to file your petition properly to ensure your loved one is issued a K-1 visa as quickly as possible. Here’s what the process entails:
First, you’ll need to file Form I-129F, (Petition for Alien Fiancé(e)). A part of this will include proving your romantic relationship. This is generally done by providing evidence such as photos, travel records, texts, emails, and stating that you intend to marry in the United States. Visa processing time can vary but it is usually a few months.
The USCIS (U.S. Citizenship and Immigration Services) will review the petitioner’s information. In some cases, they will ask for more information and send you a Request for Evidence (RFE). This could include asking for proof that the petitioner can financially provide for their partner. Once approved, you’ll receive a Notice of Action (Form I-797), and your case will be forwarded to the National Visa Center.
Once received, the NVC will assign a case number and forward the petition to the U.S. embassy or consulate in the fiancé(e)’s country.
Next, the foreign fiancé(e) must complete Form DS-160 (Online Nonimmigrant Visa Application) and schedule an interview at their local embassy or consulate. Required documents include their passport, medical examination, proof of relationship, and proof that their partner can financially support them in the United States.
If approved, the foreign fiancé(e)’s passport will have the K-1 visa attached to it. The foreign fiancé(e) can travel to the United States and must enter the country within six months of the visa’s issuance. Upon entering the U.S., the couple has a 90-day window to get married.
Once legally married, the foreign spouse can file Form I-485 (Application to Register Permanent Residence or Adjust Status). This process will begin the clock for their two-year conditional residency. Ninety days before this two year ends, file Form I-751 (Petition to Remove Conditions on Residence) to convert the two-year green card to a permanent one.
